US Judge Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her order, the court pointed out that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
